This document (as well as other documents referenced herein) governs the terms under which this Website (www.beachvalencia.com) is used, and the purchase or acquisition of products and/or services through it (hereinafter referred to as the Conditions).

For the purposes of these Conditions, it is understood that the activity carried out by the Vacation Rental of Short and Medium-Term Homes through the Website includes:

  • Rental of vacation homes for short and medium terms.

Before accessing, browsing, and/or using this Website, the User must read the Legal Notice and the General Terms of Use, including the cookie policy, privacy policy, and data protection policy of the Vacation Rental of Short and Medium-Term Homes. By using this Website or making and/or requesting the acquisition of a product and/or service through it, the User agrees to be bound by these Conditions and all previously mentioned policies. If the User does not agree with any of them, they should not use this Website.

These Conditions may be modified. The User is responsible for reviewing them each time they access, browse, and/or use the Website, as the applicable Conditions will be those in effect at the time the product and/or service acquisition is requested.

2. THE USER

Accessing, browsing, and using the Website grants the User (hereinafter referred to individually or collectively as the User or Users) the status of a user, thus accepting all the Conditions set forth from the moment they begin browsing the Website, including any future modifications, without prejudice to the application of the relevant legal regulations that may apply.

The User assumes responsibility for using the Website correctly. This responsibility includes:

  • Using this Website solely to make inquiries and legally valid purchases or acquisitions.
  • Not making any fraudulent or false purchases. If it is reasonably considered that a fraudulent purchase has been made, it may be canceled, and the relevant authorities will be notified.
  • Providing truthful and lawful contact details, such as email address, postal address, and/or other details (see Legal Notice and General Terms of Use).

The User declares they are over 18 years old and legally capable of entering into contracts through this Website.
The User may formalize, at their choice, the service contract with BEACH VALENCIA LUXURY S.L. in any of the languages in which these Conditions are available on this Website.

3. CONTRACTING PROCESS

Users who are properly registered can make reservations on the Website using the established means and methods. They must follow the online booking procedure on www.beachvalencia.com, during which a property can be selected, filled with the user’s details, and then click “Pay.”

Furthermore, the User must complete and/or check the information requested at each step. However, during the booking process, before making the payment, the booking details can be modified.

The User will then receive an email confirming that beachvalencia.com has received their booking request and/or service provision, i.e., the order confirmation. In some cases, this information may also be made available to the User through their personal connection space on the Website.

Once the booking procedure is complete, the User agrees that the Website will generate an electronic invoice, which will be sent to the User by email and, if applicable, through their personal connection space on the Website.

The User acknowledges being aware, at the time of booking, of certain specific booking conditions related to the service in question, which are displayed along with the presentation or, if applicable, the image of it on the property’s page on the Website. These conditions include, but are not limited to: name, price, features, location, house rules, and the process for checking in.

4. AVAILABILITY

All bookings for Vacation Rentals of Short and Medium-Term Homes through the Website are subject to availability of the properties and/or to any circumstance or force majeure event (clause nine of these Conditions) that affects the availability of the properties. Vacation Rentals of Short and Medium-Term Homes undertakes to contact the User and refund any amount paid for the booking. This also applies if the service becomes unfeasible.

5. PRICES AND PAYMENT

The prices displayed on the Website are final, in Euros (€), and include taxes, unless otherwise required by law, particularly in relation to VAT.

Under no circumstances will the Website add additional costs to the price of a service automatically, only those that the User has voluntarily selected.

Prices may change at any time, but changes will not affect bookings for which the User has already received a booking confirmation.

Accepted payment methods: Credit or debit card.

BEACH VALENCIA LUXURY S.L. uses all available means to ensure the confidentiality and security of payment data transmitted by the User during transactions on the Website. The Website uses a secure SSL (Secure Socket Layer) payment system.

Credit cards will be subject to checks and authorizations by the issuing bank. If the bank does not authorize the payment, beachvalencia.com will not be responsible for any delays or lack of delivery and will not be able to finalize the reservation with the User.

Once BEACH VALENCIA LUXURY S.L. receives the booking order from the User through the Website, a pre-authorization will be made on the relevant card to ensure that sufficient funds are available to complete the transaction. The charge will be made before the arrival at the property or confirmation of the service provided in the established form and, if applicable, location.

By clicking “Pay,” the User confirms that the payment method used belongs to them.

6. TECHNICAL MEANS TO CORRECT ERRORS

The User is informed that if an error is detected in the data entered for processing their purchase request on the Website, they can modify it by contacting Vacation Rentals of Short and Medium-Term Homes via the contact spaces available on the Website. The User can also correct such information through their personal connection space on the Website.

The User also has access to the shopping cart, where they can make modifications before clicking “Pay.”

7. RETURNS

In cases where the User purchases products through or on the Website, they are entitled to certain rights, as listed and described below:
Right to Cancellation
The User, as a consumer, makes a reservation on the Website and therefore has the right to withdraw from the reservation within 14 calendar days without the need for justification.

This cancellation period will expire on the number of days marked by the rate chosen in the User’s booking or a third party authorized by them, distinct from the User on the Website of Vacation Rentals of Short and Medium-Term Homes.

To exercise this right to cancel, the User must notify their decision to cancel to Vacation Rentals of Short and Medium-Term Homes. This can be done through the contact spaces available on the Website.

8. NULLITY

If any of these Conditions are declared void and ineffective by a final decision of a competent authority, the rest of the clauses will remain in force.

9. ENTIRE AGREEMENT

These Conditions and all documents referenced expressly herein constitute the complete agreement between the User and BEACH VALENCIA LUXURY S.L. in relation to the booking of the corresponding apartment and any previous verbal or written promises made between the parties.

10. DATA PROTECTION

The personal information or data provided by the User during a reservation on the Website will be processed in accordance with the Privacy or Data Protection Policy (contained, if applicable, in the Legal Notice and General Terms of Use).

By accessing, browsing, and/or using the Website, the User consents to the processing of this information and declares that all information provided is truthful.

11. APPLICABLE LEGISLATION AND JURISDICTION

Accessing, browsing, and/or using this Website and making bookings through it will be governed by Spanish law. Any dispute, problem, or disagreement related to the access, navigation, and/or use of the Website or the interpretation and enforcement of these Conditions will be submitted to the non-exclusive jurisdiction of Spanish courts.

12. COMPLAINTS AND CLAIMS

The User can send complaints, claims, or any other comments to BEACH VALENCIA LUXURY S.L. using the contact details provided at the beginning of these Conditions (General Information).

BEACH VALENCIA LUXURY S.L. also has official complaint forms available to consumers and users, which they can request from Vacation Rentals of Short and Medium-Term Homes at any time, using the contact details provided in the first clause (General Information).
